Appellate Law

Not all decisions are final

After a decision is rendered in a civil or criminal law trial by a trial judge or jury, the party who loses has the right to have the decision reviewed by a higher court. Appellate Law (also known as appeals process or appellate procedure) consists of the rules and practices by which higher courts review lower court judgments. The Appellate Practice Section of Cokinos, Bosien & Young works hand-in-hand with our litigation team to provide clients with thorough representation. Our practitioners handle civil appellate matters covering all types of commercial and business litigation, including contractual or transactional, employment, business tort, and surety disputes. Our appellate section includes a team of dedicated lawyers who focus their practice on representation before Texas' appellate courts, the Texas Supreme Court, the Fifth Circuit Court of Appeals, and other federal appeals courts nationwide.

Working hand-in-hand with the litigation team

Cokinos, Bosien & Young appellate lawyers work from the premise that appellate matters must be considered throughout the litigation process to fully protect clients' interests. Our appellate counsel routinely advise and consult with trial counsel throughout the development of a lawsuit, to preserve error and identify issues for appeal. Appellate attorneys especially contribute to the purely legal issues that arise during any trial, including pre-trial motions, privilege disputes, jurisdictional challenges, petitions for writ of mandamus, research on critical evidentiary issues, and the court's charge to the jury. Cokinos, Bosien & Young's appellate attorneys counsel our litigators on how to ensure preservation of an opponent's error for later appeal, and bring a crucial voice to the strategic decisions made throughout litigation. Once a matter reaches the appellate process, we target key issues from a fresh perspective, frame them in persuasive appellate briefs, and understand the unique aspects of appellate oral advocacy. Routinely, clients will ask our appellate practice attorneys to offer their expertise in handling disputes only after facing the litigation process. Our attorneys can offer the expertise necessary to accept the challenge of reviewing an unfamiliar case and prepare winning appellate arguments. That same experience allows us to draft persuasive amicus briefs to courts in support of cases that present issues of critical importance to our clients. Cokinos, Bosien & Young appellate lawyers have a proven track record of success in adding value to our litigation practice, securing favorable decisions for our clients, and representing our clients' positions in the crucible of legal disputes.
